1. Agreement to Terms

3. No Guarantee of Results

While we strive to deliver high-quality services and results, we do not guarantee:

• Specific revenue increases
• Specific lead volume
• Specific return on ad spend (ROAS)
• Business growth or profitability

Marketing results depend on multiple external factors including market conditions, competition, offer quality, sales process, and advertising platform changes. Past results do not guarantee future results.

4. Client Responsibilities

Clients agree to:

• Provide accurate business information
• Provide timely access to ad accounts, websites, and CRM systems
• Approve or reject campaigns in a timely manner
• Comply with advertising platform policies
• Handle all sales, fulfillment, and customer service related to generated leads
• Ensure proper consent is obtained before sending SMS or email communications

Failure to provide required access or cooperation may delay results and does not constitute grounds for refund.

5. Payments and Billing

• All fees are outlined in your service agreement or invoice
• Payments are due according to the agreed billing schedule
• Late payments may result in suspension of services
• Ad spend is separate from management fees unless otherwise stated
• All payments are non-refundable unless otherwise stated in writing

We reserve the right to use third-party payment processors, including Stripe.

6. SMS Messaging Terms

By providing your phone number through our website or any associated landing pages, you consent to receive SMS communications from Media Madness LLC or our clients, which may include appointment reminders, marketing messages, promotional offers, follow-up messages, and customer service communications.

Message Frequency: Message frequency may vary depending on user interaction and campaign activity.

Message & Data Rates: Message and data rates may apply depending on your mobile carrier plan.

Opt-Out: You may opt out at any time by replying STOP. After sending STOP, you may receive a confirmation message and will no longer receive SMS messages unless you opt in again. For assistance, reply HELP or contact us through our website.

Consent: Your consent to receive SMS messages is not a condition of purchase. Media Madness LLC complies with applicable federal and state laws, including the Telephone Consumer Protection Act (TCPA).

Carrier Disclaimer: Mobile carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and message & data rates may apply.

7. Email Marketing Terms

8. Intellectual Property

All materials created by Media Madness LLC — including ad creatives, copywriting, funnels, automations, and campaign strategies — remain our intellectual property until full payment is received. Upon full payment, clients are granted a non-exclusive license to use materials for their business purposes.

You may not resell, redistribute, or copy our proprietary systems without written permission.

9. Third-Party Platforms

Media Madness LLC is not affiliated with or endorsed by Meta Platforms, Google, TikTok, or any other advertising platform. We are not responsible for account suspensions, ad rejections, platform outages, or policy changes. Clients are responsible for complying with each platform's terms and advertising policies.

10. Limitation of Liability

To the fullest extent permitted by law, Media Madness LLC shall not be liable for loss of revenue, loss of data, business interruption, indirect or consequential damages, or platform bans or advertising account restrictions.

Our total liability shall not exceed the amount paid for services in the previous 30 days.

11. Confidentiality

We agree to keep client business information confidential and not disclose it to third parties except as required to perform services or by law. Clients agree not to disclose proprietary processes, strategies, or systems used by Media Madness LLC.

12. Termination

Either party may terminate services according to the signed service agreement. Upon termination, outstanding balances remain due, active campaigns may be paused, and access to proprietary systems may be revoked.

13. Refund Policy

Unless otherwise stated in a written agreement:

• All service fees are non-refundable
• Advertising spend paid to third-party platforms is non-refundable
• Setup fees are non-refundable

14. Disclaimer

All information on this website is provided for informational purposes only and does not constitute legal, financial, or business advice.

15. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts located in Florida.

16. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the website after changes constitutes acceptance of the new Terms.
